Indiana Workers’ Compensation Law: Recent Developments with Permanent Total Disability Benefits

The Indiana Workers’ Compensation Law provides several benefits to employees, including, but not limited to, permanent total disability benefits. These benefits are paid when it is established that the employee can no longer work in reasonable employment.

A PTD award is paid for 500 weeks at the rate of two-thirds (2/3) of the employee’s average weekly wage prior to injury. See Indiana Code § 22-3-3-8 and Indiana Code § 22-3-3-10.

It should be noted that PTD benefits are offset by the number of weeks of temporary total disability benefits paid. For example, if an employee earned 100 weeks of temporary total disability benefits and was later found to be entitled to PTD benefits, by offsetting TTD benefits, the employee would be entitled to 400 weeks of PTD benefits.

In a recent Indiana Court of Appeals case, 6 NE3d 509, an injured worker filed a claim for permanent total disability benefits. The Indiana Workers’ Compensation Board judge determined that the injured worker was not entitled to an award of PTD benefits. The injured worker appealed the unfavorable decision to the Indiana Court of Appeals, which upheld the unfavorable decision.

The Indiana Court of Appeals noted that in order to establish a PTD claim, an injured worker must prove that they are unable to perform reasonable types of employment. The reasonableness of the type of employment is determined by evaluating the individual’s physical and mental fitness for the opportunities and their availability.

The Indiana Court of Appeals further noted that once an injured worker has established the degree of physical disability, along with other facts such as the claimant’s ability, education, training, or age, and has established that he has tried unsuccessfully to find work or that it would be futile to seek work in light of his disability and other characteristics, the burden of producing evidence that reasonable employment is regularly and continuously available then falls on the employer.

The injured worker argued that the workers’ compensation judge should have awarded PTD benefits based on: 1) the vocational expert’s testimony about significant erosion of the occupational base; 2) the opinion of the treating physician on the applicable functional limitations and restrictions; and 3) testimony about how the injured worker was functionally unable to work.

The injured worker also asserted that, having met his burden of proof, the burden shifted to employ to present evidence “that reasonable employment is regularly and continually available.” The injured worker further asserted that because the employer did not challenge his EV’s testimony and because the treating physician was the only physical medicine rehabilitation specialist to examine him, the Board should have given his views greater weight.

The Court noted that the injured worker had not sought employment since the accident. But that the worker maintained that the totality of the evidence showed that there is no reasonable employment as a matter of law. In support of his assertion, the injured worker asserted that he was fifty years old; he had a medium to heavy duty background; he was unable to return to his previous job or a job of similar ability; he couldn’t lift more than 10 pounds; he couldn’t bend, reach, stoop, or twist; he needs to change position every half hour and can only stand for a limited time; and that he felt that he could only work an hour or two before going to bed.

The Court points out, however, that the worker has a college; he could lift up to a total of 50 pounds; and he was able to drive independently. In fact, even though he was assigned a PPI rating of 30%, none of the doctors who examined the injured employee stated that he was unable to work. Instead, one of the doctors who examined him concluded that he can return to gainful employment.

The injured worker also argued that his VE’s report should not have been disregarded because the inaccurate history given to VE and the VE’s failure to review all pertinent medical evidence was not material to his VE’s conclusions. However, the Court stated that the injured employee’s position would require a re-evaluation of the evidence, which he was unable to do.

The Court of Appeals concluded that the injured worker had not shown that it would be futile to seek work in light of his disability. In doing so, it concluded that there was sufficient evidence to support the conclusions of the workers’ compensation judge and that the conclusions were sufficient to support the decision.

Takeaway: This example should serve as a reminder to workers’ compensation attorneys regarding the burden of proof for an injured worker in a PTD claim.

Specifically, this case shows the importance of having a valid functional capacity assessment recognized by the treating physician and having a vocational expert provide an accurate report based on the restrictions identified in the FCE and the opinion of the corresponding physician. Additionally, the vocational expert must review all relevant medical records to complete a report. Until then, the burden of proof does not shift to the employer to present evidence that reasonable employment is regularly and continuously available.

The commuter bike segment of the Indian bike industry has only seen bikes with less power until the advent of the Hero Glamour. After parting with Honda Motors, Hero MotoCorp has revamped the model in 2011 and it has become the best-selling 125cc Hero motorcycle. The Glamor looks more like a 150cc bike than a 125cc one.

This 125cc engine generates a peak power of 9PS at 7,000rpm and a peak torque of 10.35Nm at 4,000rpm. The bike has kick start and auto start options. Ignition is DC-digital CDI with TCIS type. The 2014 Glamor FI variant has a full transistorized ignition system. The clutch is a wet multi-plate type and the gearing is a 4-speed constant mesh type. The Glamor has fantastic mileage of 60-65 kmpl in the city and 70-75 kmpl on the highways. The bike takes 7.5 seconds to accelerate from 0 to 60 km/h and has a top speed of 95 km/h.

A 3 Ah maintenance-free battery, 35-watt halogen headlamps, a 5-watt taillight, a 21-watt brake light and 10-watt turn signals make up the Glamor’s electrical system. The bike’s full analog console has a speedometer, trip meter, fuel gauge, and low fuel indicator.

The Glamor’s chassis is a double cradle with telescopic hydraulic shocks at the front and rectangular swingarm with 5-step adjustable shocks at the rear. The 18″ wheels have 2.75×18-42 P tires at the front and 3.00×18-52 P tires at the rear. UPVC Doors: Common Problems and How to Fix Them

UPVC doors are by far the most common type of door in use throughout the UK today. They are often thought of as maintenance free as they do not require painting or varnishing to maintain their appearance and waterproof qualities. However, UPVC doors can develop problems and if these problems are not fixed quickly, they can quickly turn into more complex and expensive problems. Let’s take a look at the various problems that can occur with a UPVC door.

The door locks on the side or bottom of the frame.

UPVC doors are heavy and expand and contract with changes in temperature. This means that the hinge can wear out and the door can become misaligned with the frame. The easiest way to check if this has happened to your UPVC door is to look at the miter joints at the corners of the door and frame. If the miters do not line up, it is necessary to realign the door with the frame. Look at the hinges to see how to adjust the door to move toward or away from the hinge. If the bottom corner of the UPVC door is too low, the top hinge must be adjusted to move the door toward the hinge and the bottom one away from the hinge. Adjust the center hinge halfway between the top and bottom hinges. If you can’t realign the door with the frame then it will have to be “toe and heel” which involves re-packing the panels within the frame to alter the shape of the door.

The handles are stiff to operate.

If your UPVC door handles are stiff when lifted or pushed down, then the multi-point locking mechanism is not aligning properly with the frame brackets. Guards are the metal parts of the frame on which the hooks, rollers, latches of the multipoint lock are located when the door is closed. If the door is square in the frame (see above) and the handles are still stiff, the multi-point lock is likely very worn and will break very soon. It would be advisable to have it checked by a locksmith before it fails and you can’t open the UPVC door because the lock has broken.

Handles go up but key can’t be turned

If the key on your UPVC does not turn fully to lock the door after lifting the handles, either the locking points do not move fully into the frame brackets or the cylinder is damaged. If the door is flush with the frame (see above), call a locksmith to look at the lock.

The door is unlocked but the handles do not go down

This happens when the multi-point locking mechanism breaks, usually after the handles have been stiff or difficult to operate for a while. If this happens to you, don’t be tempted to try to open the door yourself, as you can do a lot of extra damage doing so. The best approach is to call a locksmith who will be able to open your UPVC door without damaging it. They will then be able to replace the broken parts of the multi-point locking mechanism and realign the door to prevent the same thing from happening again.

UPVC door can be closed but does not stay closed

If your UPVC door swings open after closing, then the latch does not engage the tower. This can usually be fixed by moving the latch bolt towards the door. there are usually two screws that need to be loosened to allow adjustment to be made.

UPVC door handles are loose or loose

This is usually caused by wear on the handles or the locking mechanism. If the handles are loose on their back plates, they will need to be replaced.
