The fundamental role of marketing in business

One of the things that I think most people in the marketing world take for granted is that everyone understands the critical role of marketing in business. However, through my daily interactions with other business owners over the past few years, I have been struck by the relative lack of understanding about the importance of marketing. Most of the time, marketing is a backseat tertiary thought that comes after your product/service and day-to-day operations, if it is such a high priority.

One of the phrases that my business partner, James Orr, has coined in real estate investing is that “it all starts with motivated sellers.” Without motivated sellers, there are no properties to buy, rents to put up tenants, uppers to fix, or wholesale deals. This is such an important aspect of real estate investing that it’s almost a mantra for the way James and many other successful real estate investors run their businesses. The key to contacting motivated sellers is marketing.

I guess a good place to start this discussion is to define what marketing is. Google defines tells us that marketing is “the process of planning and executing the conception, pricing, promotion and distribution of ideas, goods and services to satisfy customers”. There really is more to marketing than most people think it does. Marketing is more than just the activities that drive sales. Rather, marketing encompasses all activities that seek to identify what consumers want and how to promote and deliver those goods and services.

Before an individual or business makes a decision to produce a particular product or service, they must first spend time determining if there is a market for that offering. If there is a demand, they must figure out how to get that offer to consumers who want it, how to tell consumers that it is available, and how to price it so that there is money left over for a profit. This is all part of the marketing process, and really should happen before the product itself is produced.

In the most common usage of the term, “marketing” is often thought of only as the promotional aspect of a product or service that is already available. This part of marketing consists of making the consumer aware of what you are offering and convincing them to buy it. There is a tendency in corporate environments to separate marketing and sales functions into disparate departments, which is often a mistake. The purpose of the promotional element of marketing is to drive sales and therefore the two functions are intimately connected. A good example of the disconnect between these two departments is when companies that sell capital goods have many more people in their marketing departments than they do in their field sales force. Another example is when marketing and product development people ignore input from field sales people. This input often stems from actual customer contact, which most employees in large organizations do not experience.

The main goal of one of my blogs is to test marketing promotions using a wide range of messages, mediums, and markets, which are often referred to as the three M’s of marketing. Before running a test, we first do some background research to determine if there is a market for what we are considering selling, and look at whether we can at least break even in the marketing test using some realistic assumptions about sales. proportions. The pricing strategy is also something we discuss a lot before launching a new test. The actual development of sales copy, writing and placing ads, setting up measurement systems, etc. comes later in the process. The next thing is to do sales and tracking metrics, and then adjust marketing.

Unfortunately, many business owners do not understand the importance of marketing. Because of this, they fail to plan for difficult times in the business cycle, such as slow seasons, economic downturns, and other events. As the cliché goes, “failing to plan is planning to fail.” Every business should have a marketing plan of some sort, and it should be in writing. Businesses that don’t “do” marketing will invariably fail.

In short, without marketing there are no sales. And without sales, there is no income. And without income, any business will quickly succumb to statistics showing that almost 2/3 of all businesses fail within the first 4 years.

Bad Faith Nondisclosure Statements May Result in Penalties

In 2014, a California appellate court in the case of Peake v. undergrowth provides a lesson on why a real estate buyer should not base non-disclosure of defects claims on the bald reasoning that non-disclosure of the measure those who had home repairs made when a physical inspection report shows that the same type of defect existed in the property.

The Sellers had purchased a home in 2007 and were represented by a real estate agent in the transaction. The Sellers sold this home to the Buyer approximately one year later and the Sellers were once again represented by their previous agent. The buyer was represented by his own real estate agent.

Two years after purchasing the home, the Buyer sued multiple parties, including the Seller’s agent. The buyer alleged that “standing water was caused to seep into the foundation…causing the foundation and attached floor structures to deteriorate.” The buyer claimed that “he only realized the extent of the [water-intrusion] damage” after she bought the house and the seller’s agent did not disclose this problem.

The crux of Buyer’s allegations was that Seller’s agent (I) was aware of the unrepaired water damage and deteriorated floor structure at the time of sale, but did not disclose these facts, and (ii) knew or should have known, and not to disclose that the repairs made to the property “were not adequate and did not meet applicable building codes and standards.” Buyer alleged that this failure meant that Seller’s agent had violated disclosure laws required by California law by failing to conduct a competent and diligent inspection pursuant to California Civil Code sections 1102 and 2079.

Not long after Buyer filed her complaint, Seller’s agent’s attorney sent Buyer’s attorney a series of communications explaining the factual and legal deficiencies of Buyer’s claims against Seller’s agent and encouraged the attorney to consult with an expert in real estate standards of care. Seller’s agent’s attorney emphasized that Seller’s agent had provided Buyer with all information in his possession, including documents showing possible subfloor problems, noting that an agent’s legal duties are limited to a visual inspection . Seller’s agent’s attorney reminded the attorney of their continuing duty to reassess the merits of Buyer’s claim and warned that if Buyer did not dismiss Buyer’s claim, Seller’s agent would seek sanctions from Buyer and attorney under Section 128.7 of the United States Code. California Civil Procedure.

Approximately one year after the lawsuit was filed, Seller’s agent served Buyer and her attorney with a motion for sanctions pursuant to section 128.7. Seller’s agent argued that the cited statutes under which Buyer sought liability (Civil Code sections 2079 and 1102) required that a real estate agent reveal only visible defects and that the rotted subfloor problem was not visible on reasonable inspection. He also argued that the statutes did not require the seller’s agent or broker to independently verify the seller’s representations.

In support of his motion, he submitted the three-page legal transfer disclosure statement (TDS) provided to Buyer during escrow stating that Seller was not aware of any “[f]flooding, drainage or grading problems” at the property. This form clearly states that the representations therein were made by the Sellers, not the Seller’s agent.

Second, the Seller’s agent submitted a copy of the Visual Inspection Checklist stating “SEE INFORMATION ON DRAIN UPDATES BY PREVIOUS OWNER”. This checklist form also noted a “WEAK POINT IN A ROOM’S SUBFLOOR.” Finally, this form noted: “SEE PREVIOUS INSPECTION REPORTS, DRAIN UPDATE REPORT AND CIVIL ENGINEER WORK, KENNETH DISCENZA [phone number] AND CONSTRUCTION BONDS. THE DRAINAGE IMPROVEMENTS WERE DONE IN TWO SEPARATE PROJECTS.”

Finally, Seller’s agent presented evidence that Buyer received the aforementioned inspection report from a previous sale of the property that revealed substantial problems and deterioration in the subfloor of the home.

Given these facts, the court ruled that Buyer’s claim was frivolous and that both Buyer and her attorney were aware of the complete lack of merit of the claims against Seller’s agent. The court gave little or no weight to the allegation that it was not specifically conveyed to Buyer that the previous owners did not complete all repairs (ie, repair of rotten subfloor structure). The appellate court quickly concluded that the fact that the subfloor is not visible and its exact condition cannot reasonably be determined by visual inspection. Because of this, the broker is not charged with investigating this particular condition.

The court addressed Buyer’s claims that Seller’s agent committed fraud by not disclosing his knowledge of the unrepaired condition of the subfloors. It is a well-established law in California that when the seller knows facts that materially affect the value or desirability of real property and also knows that such facts are not known to, or within reach of the buyer’s diligent attention and observation, the seller’s agent has a duty to disclose them to the buyer. Failure to do so may subject the seller’s agent to claims of fraud.

The court noted that even assuming Seller’s agent knew more about the incomplete repairs and the extent of subfloor damage than was actually disclosed, Buyer herself was notified of the subfloor’s defective condition. The buyer was aware of the property’s drainage problems and had received old photographs of rotted subfloors. These facts meant that the Buyer was aware to investigate if there were any necessary repairs left after the drainage problem was fixed. The court held that Buyer was unreasonable in concluding that because the drainage system was repaired, this also meant that the subfloor was repaired.

In the end, the court of first instance fined the Buyer and her attorney $60,000, an amount incurred by the Seller’s agent to defend himself in the action.

This case is a warning to anxious plaintiffs and their attorneys that they will be charged with knowledge of defective property conditions revealed in inspection reports issued years before the buyer purchased a home. The court found that Buyer’s recounted argument about representations that the drain was repaired as the functional equivalent of saying the subfloor was repaired was simply untenable. In other words, they are two different defects and Buyer cannot claim that it was somehow led to believe that all defects were repaired.

In the absence of a previous physical inspection report specifically mentioning some rotten subfloors, one wonders if all the references to drainage and repair problems would also have supported the court’s conclusion that the complaint was frivolous. Even though the drainage problem caused the subfloor to rot, would a buyer be advised to investigate the subfloor if he or she only had prior knowledge of a previous drainage problem? That answer is not so clear cut and would involve other issues such as the sophistication of the buyer and the reasonableness of, say, not hiring a home inspector. That is a case for another day.

This case is a good reminder to pay close attention to each and every fact in any inspection report made on the property because the facts in it can go to the heart of non-disclosure claims.

EARLY

As a child I used to make Christmas cards for my family, little scenes of houses covered in snow. I glued glitter to the snow, and that was magical too, because the snow I had painted reflected light, just like real snow. Everyone in my family liked the cards.

Later, in art school, I learned to paint and draw light and shadow, a very important skill to create volume in a two-dimensional world. And this is, today, what I continue to teach. The ability to make light and spectacle creates a dimension that synthesizes the three-dimensional volume. We are all programmed to see this third dimension in a two-dimensional illusion. This is the way we see.

LIGHTING SPECIALIST

I took a job as an assistant in a lighting show room. It was going to be a temporary thing, while I set up my studio, but I found that I was really interested and eventually took a test to become a lighting specialist. I liked to advise clients on lighting options and the whole business aspect.

I began to see that light was important in my work as an artist. If I was sculpting the figure of a horse, it was important to me how the light illuminated the three-dimensional object. When I painted, I discovered that light infused two-dimensional surfaces in two ways: one, when light and shadow were represented using light colors and dark colors, and two, when just using the colors I could go from light to dark and represent light and shadow like that. Then everything related to art history came to mind, grids, light and shadow painting to represent space and I started painting that way. The effects were amazing.

HISTORY OF LIGHT REPRESENTED

Light and shadow weren’t always what art was all about. In many current cultures and in Western civilization from primitive to medieval times, representing volume and dimension was not important. Icons, religious images that were drawn or painted did not need depth of space. Flat, iconic symbols of deities and religious figures representing social concepts and spiritual inspirations needed no space, light, or shadow.

In the Renaissance, artists began to create spaces based on perspective, light, and shadow. They built large panes of glass, framed and often on wheels. On the glass surface they drew a grid. They rotated the grid to what they wanted to paint, a landscape, a group of figures, or a figure, and worked from the quadrant (a specific space on the grid). They had to sit very still and not move much, or their vision of looking through the glass grid and their subject might change.

Artists such as Michelangelo, DaVinci, and Albrecht Durer, who used this grid, began to see how objects they looked at receded in space, that is, in the distance, things got smaller in very exact increments. That recession of objects in distant space would turn into an actual mathematical calculation. It was a great mix of science and art, so typical of the Renaissance dynamic of knowledge.

This illusion drawing and painting of the third dimension using a grid to locate objects in space and transferring them onto a two-dimensional plane became the way we see things today. We look at magazines, videos, movies, apps and with this new visual data we never question our visual alliance with the illusion of the third dimension. And we react consciously and subconsciously to this illusion. A horror movie could scare us deep enough to influence our behavior, perhaps for the rest of our lives. Or a pleasant scene in a movie, magazine, or online website can stimulate and enhance certain memories that calm and soothe us. We are, in fact, believers in illusion and are very absorbing with what we see.

FUTURE REVELATIONS

After thirty years of teaching art, working as a lighting specialist and artist, I began to see that light is something very personal, a driver of my own artistic endeavours. I see through teaching and retail interactions that all of us are very much influenced by the quality of light. I can see, although I have not investigated this scientifically, that light affects us much more than we think. The qualities of light in a workplace influence our work habits. In our homes, our lighting plays an important role in how we interact with our surroundings. I know this from years of consulting and recommending lighting solutions and receiving positive feedback from my clients.

The way we perceive events in our own lives, and specifically aging, is influenced by lighting. I believe that early in our own development as human beings, sunrise and sunset were very important spiritually and logically. Many cultures: Stonehenge, the Peruvian Indians, developed their cultures around sunrise and sunset. Artificial lighting has made transitions for us, it has expanded us into a time zone where we can work more, but also create more. It has also demystified the rule of the sun in our lives because we have created our own lighting. This has been a big cultural change as well.

Now that I am 70 years old, I see that the light in its many manifestations has guided me throughout my course of existence. When I was building my artwork for a graduate exhibition at the Pratt Institute, making carved shapes on old doors, I sprayed the cracks in those constructions with iridescent paint and blacklighted my structures. What I wanted to show is that those iconic figures, so medieval in shape, and carved into the doors were backlit by light that was very contemporary. There was a spiritual quality there that was medieval, a kind of inverted church window where the light came out of the church, instead of coming in from the outside.

Since then, my artistic endeavors have gone into many areas: collage, printmaking, oil painting, watercolor, acrylic painting, mixed media, quilts, art apparel, and more. In every investigation of the materials and the techniques and skills needed to master those areas, the light has always been behind those projects.

My feeling is that light is also a life-generating factor that imbues each of us with a primordial spiritual force and that we feel very comfortable with it. But if we sit, for just twenty minutes, in any corner of a room and observe the light in any object, we will begin to see how this incredible phenomenon can affect our lives. And perhaps what will be revealed is that the concept of light perception has been shown, through many definitions of light in many languages, to define inspiration, spiritual contact, realization and visualization that advances thought and creative action.

How Safe Is Your Cookware Set: Health and Safety Features

The stainless steel lining can last the life of the cookware, but the tin lining will need to be renewed periodically as it can wear away with long use and high temperatures. Weight loss is a pain in the ass!

From what I’ve learned, there’s a lot to “weight loss.” First it’s 80% diet and 20% exercise, which I thought was full of crap from the start because I figure if you get your body constantly moving, you won’t have to worry about the food you’re eating. WRONG! I’m a foodie, so I thought with my exercise plan I could get away with it. NO!

Nutrition consists of three main things: protein, carbohydrates, and fats help build muscle, tone the body, and give energy. If you are eating fried and sugary foods (which mostly contain fat and who cares what kind of fat). For your diet, or ahem your “lifestyle change”, you need about 60% carbs, 20% protein, and 20%, which may or may not be exact, but close. So eating junk and exercising won’t help you lose weight. So what I did was switch to a clean, healthy diet, AND stop drinking sodas. Which was the hardest of all. Check the previous article written by me 🙂

Oh, and it gets better kids!!! I thought that now I should be losing pounds, and not exactly… look, I changed the way I eat, I gave up sodas and was still exercising… now, before I gave up sodas and changed my eating habits, I still haven’t lost any. , but when I did I lost weight because I stopped drinking soda. But not from exercising.

Here’s the deal! You have to PUSH HARD when you exercise! My problem is that I have been taking breaks as soon as I get tired. Oh no no. You should, in addition to everything mentioned above, make sure your heart rate is in a certain range and only take a break from 30 seconds to possibly a minute so your heart rate stays up and you burn off the pounds. Therefore, I recommend investing in a heart rate monitor if you really want to lose weight. You can also find out what your heart rate is supposed to be while you exercise. I’ve lost about 5 pounds, but I’m still missing something. Have I considered the trendy weight loss products out there? Hell yeah, especially since he wasn’t having any luck doing what he thought he was doing right. But I decided not to because I want to do it the right way.

By changing my diet and exercising, I learned to love a lot of new things like eating clean, running (I’m not that much of a runner, and now I LOVE running) and drinking all kinds of healthy drinks. I try to stay away from sugary drinks, but I love Propel and some juices and am always looking for a new healthy drink to try. I also love the training equipment and the different workouts. Right now I’m doing Turbo Fire, Pilates, I have a Yoga mat (and I do Yoga too). I also have toning shoes and running shoes so I can be constantly losing weight and building muscle.

So my friends, is this how you lose weight and still be a pain in the ass? A little.
